Again: Crony Capitalism in the Obama White House

Carol Platt Liebau by Carol Platt Leibau

Giving credit where it’s due, The New York Times had quite the story today about the fraud and unjustifiable use of taxpayer dollars to line the pockets of groups tending to support the Obama administration:

Ever since the Clinton administration agreed in 1999 to make $50,000 payments to thousands of black farmers, the Hispanics and women had been clamoring in courtrooms and in Congress for the same deal. They argued, as the African-Americans had, that biased federal loan officers had systematically thwarted their attempts to borrow money to farm.

But a succession of courts — and finally the Supreme Court — had rebuffed their pleas. Instead of an army of potential claimants, the government faced just 91 plaintiffs. Those cases, the government lawyers figured, could be dispatched at limited cost.

They were wrong.

On the heels of the Supreme Court’s ruling, interviews and records show, the Obama administration’s political appointees at the Justice and Agriculture Departments engineered a stunning turnabout: they committed $1.33 billion to compensate not just the 91 plaintiffs but thousands of Hispanic and female farmers who had never claimed bias in court.

The deal, several current and former government officials said, was fashioned in White House meetings despite the vehement objections — until now undisclosed — of career lawyers and agency officials who had argued that there was no credible evidence of widespread discrimination. What is more, some protested, the template for the deal — the $50,000 payouts to black farmers — had proved a magnet for fraud.

(emphasis added)

Absolutely unbelievable.  Ever wonder how Obama can “need” higher taxes despite going on the biggest spending spree in American history? Perhaps this story offers a clue.

This is a story Andrew Breitbart was attacked repeatedly for publicizing.  But he was right — as even the Times conceded today.

Eric Holder’s Reckless Assertion

During a speech to the Mexican American Legal Defense and Educational Fund, Attorney General Eric Holder said that creating a “pathway to earned citizenship” was a “civil right.” Mr. Holder put it this way:

Creating a pathway to earned citizenship for the 11 million unauthorized immigrants in this country is essential. The way we treat our friends and neighbors who are undocumented – by creating a mechanism for them to earn citizenship and move out of the shadows – transcends the issue of immigration status. This is a matter of civil and human rights. It is about who we are as a nation. And it goes to the core of our treasured American principle of equal opportunity.

As someone who believes in earned citizenship if it’s done in the context of other steps related to border security and encouraging more high-skilled workers coming to America, perhaps I have a bit of standing to say that what Holder said is nonsense. Offering earned citizenship to illegal aliens falls under the category of prudential arguments about immigration reform. There are serious policy arguments on both sides.

But Attorney General Holder’s claim is more than simply silly; it is also pernicious. It attempts to frame this debate not on the merits of granting a pathway to citizenship for those who have violated our laws; it’s an effort to frame it as a conflict between those who support (good people) and those who oppose (bad people) basic human rights. This is an effort, in other words, to demonize those with whom one disagrees, and therefore creates yet more polarization and anger and self-righteousness in a debate that probably needs less of it.

Time to Review Administration-Picked Review Board that Found No Benghazi Conspiracy

The week’s five-committee offensive over a consulate attack cover-up is only getting hotter.

The Obama administration has leaned on the findings of its handpicked Accountability Review Board for its go-to explanation of all things Benghazi.

Lawmakers still delving into the consulate attack that killed four Americans say it’s time to review the ARB.

Then-Secretary of State Hillary Clinton convened the ARB to delve into the Sept. 11 attack, appointing four of the panel’s five members while the director of national intelligence named the final member from the intelligence community.

The ARB “examined the terrorist attacks in Benghazi with an eye towards how we can better advance American interests and protect our personnel in an increasingly complex and dangerous world,” according to the final report of the board led by former UN Ambassador Thomas Pickering. That report found there were no protests the night of the attack, that intelligence services had no warning of the attack, and that “communication, cooperation, and coordination among Washington, Tripoli, and Benghazi functioned collegially at the working – level but were constrained by a lack of transparency, responsiveness, and leadership at the senior levels.”

“The Board determined that U.S. personnel on the ground in Benghazi performed with courage and readiness to risk their lives to protect their colleagues, in a near impossible situation,” states the report. “The Board members believe every possible effort was made to rescue and recover Ambassador Stevens and Sean Smith. The interagency response was timely and appropriate, but there simply was not enough time for armed U.S. military assets to have made a difference.”

House Foreign Affairs Committee Chairman Ed Royce (R-Calif.) today introduced the Accountability Review Board Reform Act of 2013 to increase the independence and transparency of future ARBs. Under the bill, the secretary of State would appoint only two members of the board with the chair of the Council of Inspectors General of Integrity and Efficiency appointing two members, and the director of national intelligence appointing the fifth member.

Currently, an ARB uses State Department staff to assist with the investigation of other State Department employees. Under this bill, ARB staff would come from the Office of Inspector General.

So essentially, the ARB investigating the Benghazi Attack was in essence the State Department investigating itself? Sweet!

Bureaucratic Cockroaches

The FAA Strikes Again, the FAA Brags

The bureaucracy revels in its own failures.

The Federal Aviation Administration claims the sequester spending cuts are forcing it to delay some 6,700 flights a day, but rarely has a bureaucracy taken such joy in inconveniencing the public.

Though the FAA says it is strapped for cash, the air traffic control agency managed to find the dollars to update its interactive “command center” tool on its website so passengers can check if their airports are behind schedule due to what it calls sequester-related “staffing” problems. Oklahoma Senator Tom Coburn noticed this rare case of FAA technological entrepreneurship and fired off a letter Wednesday protesting what he called the agency’s “full blown media rollout” to hype the flight delays.

That had zero impact on FAA bosses, who were on Capitol Hill rationalizing their dereliction. But after Mr. Coburn published his letter on his website, FAA regional employees wrote to blow the whistle on their bosses. As one email put it, “the FAA management has stated in meetings that they need to make the furloughs as hard as possible for the public so that they understand how serious it is.”
